Division of Assets

Distribution of marital and non-marital assets can be one of the biggest stumbling blocks during divorce with many nuances to address. An experienced lawyer can help navigate through the process by defining and properly valuing the various assets as well as factoring any tax implications.

In Illinois, marital assets are divided fairly rather than equitably which requires the family law courts to determine what is marital property and what is non-marital property. Our firm has several years of experience assisting clients in providing documentation to evidence how property is held and what can be expected during the division of property.

Retirement and pensions accounts are also subject to division in divorce and can often be the most valuable asset outside of the marital home. Division of retirement or pension accounts can be complicated, but not difficult. Our experienced staff is able to effectively advocate for proper division and implementation of the necessary Qualified Domestic Relations Order(s).

It is important to note, that a dissipation of assets can be claimed if one spouse has devalued marital property or improperly spent marital funds during the irretrievable breakdown of the marriage. Such a claim requires determination of when such actions occurred and the state of the marriage.
